PRACTICE Terms of Use
These Terms are an agreement between you and the individual developer who operates PRACTICE from Connecticut, USA ("PRACTICE", "we", "us"). If PRACTICE moves to a company, that company takes our place under these Terms and we will update this page.
By using PRACTICE you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use PRACTICE.
1. Who can use PRACTICE
- You must be 18 or older and in the United States.
- You must be able to make a binding agreement, and not be barred from using apps like this one under US law.
- You confirm you are not in a country under a US government embargo and not on a US government list of prohibited or restricted parties.
2. What PRACTICE is
PRACTICE shows one card a day, the same card for everyone on a given date, with a small act to do. Cards repeat over the course of a year. You can turn a card over and write on its back, keep a journal on your phone, see your practice days and Your sky, and set a reminder.
Some features may not be in your version of the app yet. If your version includes it and you have a printed PRACTICE deck, you can log a card from it by its number, and that day counts as a practice day. Printed decks are an earlier edition: some printed cards differ from the cards in the app. Section 6 applies to printed cards too.
Marking a card done. Today's card stays open until it turns over at 3:00 a.m. in the time zone we have for your phone. That time zone follows your phone's setting: when it changes, for example when you travel, the app asks us to follow it the next time PRACTICE starts or opens Today with a connection, and we accept at most one change every 24 hours. Until 3:00 a.m. you can undo a mark. If your phone is offline, your mark is saved on the phone and sent when you are back online; it counts only if it reaches us before the card turns over, and the app tells you plainly if it arrived too late to count.
PRACTICE offers everyday prompts for reflection and kindness. It is not medical or mental health care. See section 6.
We may change, add or remove features, decks or cards. If we stop offering PRACTICE, we will give reasonable notice in the app and keep Export working for your journal until then.
3. Your guest account
- PRACTICE has no sign-in yet. The first time you mark a card done, the app makes a guest account for you, with no name or email.
- On Android, a guest account stays with the phone it started on and does not move to a new phone through a backup. A new phone starts a new guest account, and your practice days do not move with you.
- A guest account you stop using is deleted automatically, within 99 days of the last day the app reached us for it (see the Privacy Policy). You can delete it at any time in Settings > Delete my account and data, or ask us by email (see www.practicecardgame.app/delete).
4. Your journal
- Your journal and mood are saved on your phone, not on our servers, and we cannot read them. We cannot recover them for you. On Android, we ask your phone to leave your journal out of phone backups and phone-to-phone transfers, so export it before you change or reset your phone. Export is free and keeps a copy wherever you choose. Erasing your journal in the app removes it from this phone.
- Your journal is yours. We claim no rights in it.
5. Using PRACTICE kindly
- Don't use PRACTICE to bother, harass, threaten or impersonate anyone.
6. Safety and health
- PRACTICE is not a medical device and does not diagnose, treat, cure or prevent any medical condition. It is not a substitute for advice from a doctor, therapist or other qualified professional. For medical advice, diagnosis or treatment, talk to a healthcare professional.
- Some cards involve movement, going outside or being with others. Do only what is safe and comfortable for you, and skip any card that is not.
- If you are in crisis or thinking about harming yourself, call or text 988 or chat at 988lifeline.org. If you are in danger now, call 911.
7. Our content and your licence to use it
- The cards, art, design, words and software in PRACTICE belong to us or our licensors. The original PRACTICE card art is by Jessie Paulino · 0Designz.
- We give you a personal, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, under these Terms and the rules of the store you downloaded it from.
- Please don't copy, sell or republish the cards or art, scrape the service, reverse engineer it except where the law allows, interfere with its security, or use it to build a competing product. Showing a card to a friend, or telling them about it, is fine.
8. Paid features
PRACTICE is free, and there is nothing to buy in this version. If we offer paid features later, the price, what they include, how they renew and how to cancel will be shown before you buy, and separate terms will apply. Your journal and Export stay free either way.
9. Ending your use
- You can stop using PRACTICE at any time, and delete your account and the data we hold about it in Settings > Delete my account and data. www.practicecardgame.app/delete explains how deleting works.
- We may suspend or close an account that breaks section 5 or 7, puts others at risk, or is used to attack the service. Where it is safe to do so, we will tell you why.
- Sections 4, 6, 7, 10, 11 and 12 continue after your use ends.
10. Disclaimers
PRACTICE is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that PRACTICE will be uninterrupted or error-free, or that any card will suit you. Some states do not allow some of these disclaimers, so they may not all apply to you.
11. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data (including a journal that was not exported). Our total liability for any claim about PRACTICE is limited to the greater of $50 or the amount you paid us for PRACTICE in the 12 months before the claim. Nothing in these Terms limits liability that the law does not allow to be limited, including for gross negligence, wilful misconduct, or your rights under consumer protection law.
12. Disputes
- Talk to us first. Write to support@practicecardgame.app and give us 30 days to try to fix it.
- These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules.
- Any claim goes to the state or federal courts located in Connecticut, and you and we consent to those courts. Either of us may instead bring an eligible claim in small claims court where you live.
- There is no arbitration clause and no class-action waiver in these Terms.
13. Your app store
If you downloaded PRACTICE from Google Play, Google Play's terms also apply to your download and any purchase.
14. Changes to these Terms
We may update these Terms. We will post the new version here with a new date and, for material changes, tell you in the app before they take effect. If you keep using PRACTICE after that, the new Terms apply. If you do not agree, you can delete your account and stop using PRACTICE.
15. General
These Terms and the Privacy Policy are the whole agreement between us about PRACTICE. If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up. You may not transfer these Terms; we may transfer them to a company owned by the person who operates PRACTICE, or to a later owner of PRACTICE.
16. Contact and notices
Write to support@practicecardgame.app. We send notices to you in the app, and you send notices to us at that address.
